Our application has still not updated after 2.5 years. I am being told by the solicitor they are still waiting for forms but as this has been rejected once already I am very concerned. The second request was put in a year ago. The title is HP761696. What can I do to protect my rites if it’s rejected again. The solicitor is not providing me with enough information to understand the delay.

Cate - the current application was submitted in Oct 2024 and we are currently waiting for a full response to our request dated Aug 2025. A reminder was issued on 6th Oct<br> There was an earlier application submitted back in July 2023 but that was cancelled in June 2024<br> I would recommend pressing your conveyancer to confirm the reason for the delay and what's outstanding<br> HP761696

<p>I appreciate your response thank you. I have contacted them on numerous occasions and gather they are waiting on a form from trinity who they are struggling to get a response from. Is there anything I can do other than pressure the solicitor, I gather an RX2 form might be an answer is that correct? This is not a new build it was a part exchange so I’m confused why this is taking so long when the part exchange was recorded so quickly.</p>

Cate - form RX2 or RXC can be helpful in such cases<br> These things can take a long time if all parties are not responsive as you suggest. It is your conveyancer who need to press for more from those involved<br> HP761696

<p>Thank you so much for your help. Can you just confirm why a compliance certificate is required from Trinity when this is a freehold property and there has been a previous owner. This was bought back in part exchange by the builder. This is what Is holding up the process&#160;</p>

Cate - please note the restriction on the title in favour of Trinity and which needs to be complied with. Again a Q for your conveyancer to answer in detail<br> HP761696

<p>I gather my conveyancer has submitted an RX2 yesterday due to lack of response in their constant requests for an amended certificate. Can you please advise the average timescale for dealing with an RX2 and updating the register. Thank you&#160;</p>

Cate - they have responded and that response will be referred to a senior officer to consider. The expedite status will help escalate that referral but there's no average timescale so I can't be definitive re how soon it will be reconsidered. All we can state is that it will be asap so the wait will hopefully not be a long one.<br> Everything then hinges of course on their response being sufficient&#160;<br> HP761696

Can you please confirm the status of this request? I believe it was requested as an expedite request yet i still see the register has nit bern updated. Csn you please advise the current situation and a timeframe of when this will be looked at, Thank you&#160;<br> &#160;

Cate - the application was expedited and as a result processed. Unfortunately there's an issue with a restriction on the title and the conveyancer's response is waiting to be considered by one of our lawyers to decide next steps.<br> I'll see if it can be escalated to get an idea of timescales or if more is required still<br> HP761696

Is the restriction something we needed to be made aware of before we bought the property? As we don’t have deeds do we own it?&#160;</p>

Cate - first things first and your purchase/ownership is protected all the time we have the application to register<br> The restriction will have been 'known' to the conveyancer when going through the conveyancing process so they would have known that it would need to be complied with as appropriate&#160;<br> You don't need 'deeds' but it's vital that this matter is resolved to ensure the register can be updated and you recorded as the legal owners. Something your conveyancer should be reassuring you on rather than I/HMLR but to be honest your situation is not unique (albeit of course it is for you) and these things can happen.&#160;<br> Post again after the weekend and we can check again but for emphasis there's nothing to overly worry about as things currently stand and hopefully the conveyancer has done enough to enable matters to proceed<br> HP761696

Cate - wider checks are now underway with both restrictioners and those checks won't complete until shortly after 22nd Nov unless the recipients respond sooner and positively<br> HP761696
