Hello,
I'd like to lodge the HR 1 form (matrimonial rights notice)
- Where and how do I lodge it (on-line)? or post it to? (I'm in Reading, Berkshire)

- What to put in these sections:
Question 6- how do I get the reference? I assume this is the title number (?)
Question 10- what is meant by “order under section 33(5) of the Family Law Act”? How do I answer this question?

Thank you,

Olivia

Hello Olivia - it's a postal application - see link to standard address below
Panel 6 - reference - you would create your own reference and it's used mainly by conveyancers who may for example wish to match their submission to their own file reference. As a private individual I suspect you are submitting just the one form and as such can leave that field blank
Panel 10 - that is a specific order issued by a court on application. I suspect, as you are asking the question, you have not been to court to obtain such an order and as such you would select NO in panel 10

Here's our generic response to enquires re form HR1 and this may assist if more Qs arise
An application for a notice under the provisions of the Family Law Act 1996 must be made in Form HR1. You must be married or in a civil partnership and your spouse/civil partner must be the sole registered owner of the property in order that an application can be made by you or on your behalf. There is no fee payable.

Please send your completed application form to:

HM Land Registry address for applications.

Please note that, on completion of this type of application, HM Land Registry will send an information notice to the registered owner to inform them about the entry made on the register.

For further guidance please refer to Practice Guide 20: applications under the Family Law Act 1996 or refer to our pages on GOV.UK.

Land registration is complex, designed to protect legal and financial interests in property. There can be significant consequences for any error. Please consider seeking legal representation. Before making an application without legal representation, it is important to consider the benefits of using a conveyancer.
