In relation to title: SY910167 I now understand that my application is being held up by prior applications however can you please confirm how I can help to move things along. Who is being the bottleneck and what info are we waiting on so that mine can be progressed? Still not sure how exactly it relates to my own matter. Thanks

Lara - the details were explained to your conveyancer in a letter dated 23rd February issued to them confirming expedition of your own application and the reasons why matters could not be progressed currently<br> Please contact your conveyancer to confirm and to clarify what, if anything, you/they can do with regards progressing matters<br> SY910167

Is this the conveyancer at SBP? He said he has no knowledge on his side about these prior applications so I’m trying to understand who they might relate to so we can nudge as otherwise we cannot do anything with our property until these unknown conveyancers respond to a historic query from LR. Are you able to send a chaser to these people for the information you are after please?

Lara - yes. Your application to register includes a Deed of Easement date 18th July 2025 which affects more than one registered title.<br> The bottleneck as you put it is against title SY880774 out of which the various Brunswick Close properties have been transferred.<br> And the application waiting to be completed relates to land adjoining 127 Ruden Way.<br> Reminders have been issued to the lodging conveyancer Elgee Pinks LLP already

Lara - not really as it will only those directly affected by the title/Deed of easement involved.<br> My recommendation would be to speak to the companies directly involved from your own Transferee, the Management Co and the original Dalln Limited. It's the latter firm who appear to be the delay factor re the oldest application and on which that conveyancer is reliant<br> SY910167

Thanks Adam, I spoke with Dalln Limited and they actually are no longer involved with this title - Dalln was previously owner of Brunswick Close Ltd - this management company owned the land you mention above. They sold it to Earlswood Homes and have confirmed with their solicitors today that all matters from their side have been closed off, and have no open enquiries with Land Registry. What info do you need from Dalln Ltd? And have you contacted the company who they sold the land to instead?

To confirm - that was both Dalln and Philips solicitors confirming case closed on their side. Is this showing true on your system? Can they do anything to close the open application for you?

Lara - the issue relates to the loan secured against their title before part was sold off. This has been raised with the conveyancer mentioned previously and they would be liaising with Dalln Limited prior to the sale/closing off you refer to.<br> I suspect, and your latest post perhaps confirms it, that this is where the delay/issue lies as the conveyancers are struggling to resolve an issue with the original owner/lender some significant time after they believed matters had been resolved<br> The conveyancers have been reminded a number of times and the last reminder was issued 2nd Feb with a cancellation date of 2nd March<br> I'll issue a further reminder to try and elicit a swift response<br> SY910167

Lara - sadly not as we are always loathe to cancel unless there is zero chance of matters being resolved. That is not yet the case hence the reminders being issued over time as a result of the conveyancer asking for more time.<br> The issue here is, I suspect, a breakdown in communications between the conveyancers involved as one side believes the matter has been closed as you suggest<br> If I don't get a response to my own communication I will ask the casework team to consider cancellation but it will be their decision and not mine as to whether that is the action taken.

Thanks, DALLN and Philips solicitors have been very responsive and say they haven’t had any email communications about this matter. Is it therefore Elgee pinks that haven’t been responding? If there is anything that the former firms can do please let me know as I have a direct line of contact with them now

Lara - correct. We would deal with the conveyancer, not the actual transferor/grantor for example. The former firms can speak to their own conveyancers to ensure that they have complied with any previous requests or check what they did supply specifically re the form DS3 required/submitted to date

Thanks Adam- the Director of DALLN David Medcraft, and his solicitor from Phillips, Jonathan, who we have been in constant communication with over the past 24 hours, have confirmed that their paperwork is in order in terms of what was submitted. And they point to any outstanding question marks being related to Fleet Homes (Morgan danaher being the proprietor) however as is public record at companies house, Fleet Homes went into liquidation some time ago, and is no longer an active entity, thus any requests for information from them will not have been garnering any responses. In addition, the solicitor at Phillips confirms their understanding to be that Fleet Homes had a charge in favour of Hampshire Trust, which at Companies House shows has been repaid. In summation, logic would dictate that as there is no outstanding monies and the company in question went into liquidation, there will be no more communications available on the matter and as such, the application is redundant and can justifiably be cancelled. Lara - all noted and understood but this still leaves the application to transfer ownership of land from September 2021 (submitted in Nov 2023) and which remains outstanding Whilst Fleet Homes (2000) Limited, the transferor at the time, is also in liquidation the application and registration requirements remain as is. The best I can do is add a note to the case record for you so that when the cancellation date is reached early next week the casework team can review and consider next steps. Adam- the conveyancer confirmed that they have written to Land Registry on Friday to rectify matters with this delayed case. Thanks
