Adverse possession

Hi I’m buying a house which has submitted an application for adverse possession, this has been expedited due to the selling chain at are apart of, is there a rough time line to how soon this could be resolved? Thanks

Hi Mel - the application was lodged on 6th November. It has been expedited so processing will start this week.
Even with expedition, which gets it to the processing start line, it is likely to take some time to process/complete
There are generally three key stages to such applications inc consideration of the claim itself by one of our lawyers, a site visit/survey to get a report on the reality on the ground and a final stage where the registered owners are contacted to confirm their consent or otherwise to the claim
Very rough timescales re each stage are 3-4 weeks, 2 weeks and 65 days for each stage - not definitive but the key one to note is the last one. If the application reaches that final stage then that wider check/confirmation is key and the owners are given plenty of time to respond as mentioned
Please do speak to your conveyancer/legal rep to clarify the process and also firm up on the validity of the claim being made, which I am sure they will have done already for you

Thank you for this, if the land owners respond prior to the 65 days to accept the claim I assume this will speed up that aspect of the process?

Mel - that's correct. Each stage follows the previous one in order so if any fail then the next one does not happen until resolved

Sorry to be asking another question sooner than expected. One of the solicitors within the chain have said that the deadline for objection is Thursday this week? Can you see whether there is any update or notes to confirm this? I am awaiting more information/updates from my solicitors but thought I’d see whether you’d been able to see anything at your end. Mel - not sure where they have got that information from but the case has not yet passed the first two stages so we are not at the consent/objection stage as yet

The SYK number you have doesn’t correspond to any of the ones I have been told by my solicitors does that impact anything? The ones I’ve been told include SYK313724 and SYK286114

Another I have is SYK137048

Hi Mel - they won't have quoted it because it's the provisional new title allocated to the claimed land 
SYK286114 and SYK313724 are the titles for the land as currently registered 
SYK137048 is the title for #22 but no application against that but assume that's the main property being sold/bought and the other titles are the extra land now being claimed
SYK729530 is the correct one from our end re what's happening but I'm sure your conveyancer can confirm and reassure you if necessary.

Hi Adam, I am hoping you may be able to provide me with an update? I was hoping you’d be able to inform me whether we have passed stage 1 yet and whether there is anything in place for the 65 days if the current land owners have both unfortunately passed away? Also as we are currently in a chain, which has been ongoing for nearly 6 months it is causing significant delays so we hope things can get sorted sooner than later. Thanks, Mel 

Hi Mel - I have responded to your further post in the absence of my colleague. 

The application is currently with a senior officer for consideration.  They will be deciding if the application is satisfactory to proceed or not, and if it is then what actions are required.  If satisfactory, then we may possibly have to ask for a survey of the site before the 65 day notice stage can happen. 

I have just set this out to manage your expectations and hope it helps.

Hi Mel - we need more from the conveyancer and they were contacted yesterday with a request. Once they have responded in full the case will be reviewed again and nest stages considered
You'll need to rely on the seller's conveyancer to clarify/confirm the request and when they hope to respond

Could you please advise me a little further, a few of your sources online state that these type of applications can take 10-14 months, I was under the impression that it would be 3-4 weeks, 2 weeks then 65 days? Can you please advise as we are in a chain and desperate to get moving as this has already been ongoing 6 months, we require as much transparency as possible to aid our decision moving forward, is there anything that can be done to make the process quicker? Hi Mel - timescales can and do vary. The 65 days you refer to is the notice period given to registered owners of land being claimed, which is the case here. 
Expedition gets the case to the processing start line, so that's already happened and the casework team have contacted the lodging conveyancer this week with a request for more information
Once the conveyancer responds, and in full, the next stages are firstly a site visit/survey (2 weeks) if required and the wider checks mentioned 
A decision re both the site visit and wider checks won't be made until we have a full response from the conveyancer and the case has been reviewed by one of our senior technicians
Being definitive re timescales re such applications is impossible when we need more information, consideration of the complexities involved, a site visit by Ordnance Survey and then wider checks as mentioned - I would suggest making a note to post again next week and we can see if the conveyancer has responded
