Hi, I have submitted an HR1 application and have received an email receipt giving me an application reference number. Can you confirm that my spouse will no longer be able to re-mortgage / re-finance or sell the property without my consent from receipt of this application? Also, is it possible for my application to be rejected as the spouse of the house owner?

Hi Sid - an HR1 does not act in the way you perhaps envisage with regards you needing to 'consent' to any future dealings with the property. The HR1 protect s your rights as a spouse and puts others, namely lender, creditors and buyers on notice of your protected interest/rights. Once aware it would be very unusual for a lender/buyer to complete on a loan/purchase whilst your rights existed
Any application can be rejected/cancelled and I would recommend that you seek legal advice/assurances re your rights and have a read of our PG 20 for registration guidance

Hi, thanks for the response. Are my rights registered from receipt of HR1 or do I have to wait for the application to be completed?
