Good morning We have a new lease to extend the term of a headlease, and a subsequent new lease to extend an underlease (registered leasehold title) (both extensions less than 7 years). In terms of registration, we plan to request to note the headlease on the freehold title, and then note the underlease on the leasehold title. However, we can see no way of showing that the headlease has been extended on the leasehold title - it will therefore appear that the underlease has overrun the headlease. Could you please advise if there is a way of dealing with this? Many thanks Jess

Good Morning Jessica - as the underlease's title doesn't specifically refer to the head lease there's no way of showing what you refer to. There's no need to either as the under lease title stands on it's own However anyone searching the various tenures/titles would be able to check and confirm the head lease title and the extended term etc as appropriate

Thanks Adam. The underlease title does refer to short particulars of the lease showing the term, so anyone looking at the title will see the original term, but then presumably a note of the extension. Is this sufficient?

Jessica - that's correct. It will see it's own lease particulars, not the head lease, and also any reference to the extension. Any leasehold register has to be read in conjunction with it's actual lease and associated deeds hence why we only refer to the short particulars to enable readers to do just that The key consideration/concern here is ensuring that any extension is dealt with as appropriate - see Practice Guide 28
