Hello,

I have an application which has been expedited since 18th July, however there has been no progress on it since then.

Everyone I speak to keeps saying the delay is due to prior pending applications and I am wondering how long it’s going to take to get through these prior applications, since it’s over a month that the request to expedite was approved.

Can I please get a more detailed explanation as this delay is seriously threatening a sale transaction.
The title no is TT156009.

Hello Damy - the explanation already given is correct. There are 15 prior plot removals, 5 new leases and 4 separate register updates all affecting the seller/developer's title out of which your plot was purchased.
In most cases those applications don;t have any long term impact on your own plot but they do have to be considered as they have 'priority' so if they do affect then it can result in additional consideration re your plot removal and entries being made as a result. Often they don;t but it takes time to consider/process.
I'll post again once I have a concrete update from the casework team for you

Just a few more clarification points from me:
  1. I am concerned not enough progress has been made on the 24 prior applications, as this is the number I have been told for weeks now. Is there any chance it could be considered out of order given my sale is on the verge of falling through due to the delay?
  2. If it can’t be considered out of order, are you or the caseworker able to provide a rough estimate of timeline for completion. I know this can be difficult, but any suggestion will be appreciated.
  3. Lastly, from your experience, is there even the slightest chance that a sale can still be completed even though the seller’s title deeds which has been submitted is yet to be finalised due to these kind of delays. Is this something you have seen happen before?

Hi Damy - 1. it's possible and that's why I have contacted the casework team to see if that is actually a reality
2. No as if it can't be, for example because one of the prior applications affects and is not in order we are reliant on the conveyancer/applicant to resolve it. But that Q really only arises if the Answer to 1 is a negative one
3. It can and does happen but that will very much depend on the conveyancer acting for the buyer and above them the buyer's mortgage lender has the first say. Whilst it is possible to complete on a purchase of an as yet not registered individual plot there are a number of reasons as to why it might not happen and only one the buyer's conveyancer can answer

Also, the buyer is a cash buyer, so I suppose there could still be a chance.

Damy - if there's no mortgage involved then completion is all down to the buyer's conveyancer and how they approach the 'risk'.
It's similar, but not exactly the same, to your completing on the plot purchase with multiple applications pending against the seller/developer's title. Your own conveyancer will have considered that when you completed in the same way as the buyer's conveyancer would now alongside your actual Plot transfer and what that says also
But there's little point trying to understand all of that if neither conveyancer is saying that they are happy to complete now otherwise expedition wouldn't have bene requested.

Hi Danny - quick update in that the first removal instructions have been sorted and your plot removal should be up for processing this weekend, hopefully.
I can't guarantee that but things are moving in a positive direction. So hopefully everything is in order and when you check in next week we will have some better news for you - everything crossed
Just wanted to share as made aware and may help to keep that positive vibe across the BH weekend
