I’m looking for guidance on the correct Land Registry process (procedural, not legal advice).<br> A spouse registered a unilateral Home Rights Notice (HR1) against a registered title. We became aware after it was entered on the register, and we submitted an AP1 application to challenge/remove the HR1. We also requested expedition several months ago because there was an ongoing Family Court case and the HR1 was central to those proceedings. The Family Court has now decided the application in our favour (occupation order struck out on jurisdiction / alternatively dismissed for lack of evidence; explicit judgement that spouse had no matrimonial rights to the property) and has awarded costs.<br> We are awaiting the sealed order, but will have it shortly.<br> My questions are: Once we have the sealed Family Court order, is it best practice to send the sealed order to be added to the existing AP1 application, so the AP1 can be completed based on that order?<br> Alternatively, should we submit a new application using HR4 (cancellation of home rights notice) supported by the sealed order? If AP1 is already in progress (and expedited), is there any advantage/disadvantage to filing HR4 as well, or would that cause duplication/complication?<br> Title WK103672 - would appreciate an update on the AP1 application too. Shah - as your application is still 'live' I would suggest thinking about submitting the additional evidence to be added to that application. We can't tell you what to do here. The lawyer dealing with the matter will then consider/review the application further. Do speak to the conveyancer acting for advice/guidance though beforehand WK103672<br>

Thanks Adam for your reply. I sent in a new HR4 application with the court order and explained in the cover letter that we already have an AP1 pending since last year and requested that this HR4 is linked to that AP1 and processed urgently. Just had an email saying this should be processed/completed by 27 July 2026. Would you be able to give me an update on application reference L947SGV or E638YZT or if possible, have them processed quicker? It's affecting my mental health now :(

Shah - you'll get an auto-acknowledgement whenever you lodge a 'new' application and the estimated completion date won't account for anything already pending/being processed. Please ignore the 27th July 2026 estimated date as a result.<br> I'll check withe the casework team to see what's happening and offer an update once received<br> WK103672

Hi Adam, Can you please let me know what exactly is holding up the application? The last contact we had in regards to the AP1 application was back on October 13th, 2025. That's when we requested an expedition as home rights notice was central to family courts proceedings. Since then, the family court decided in our favour and gave an explicit direction to remove the home rights notice, but in all that time, we have not heard a thing from land registry which is rather disappointing as requested expedition. Now that HR4 has also been sent along with the court order, I see no reason for a hold up. If there is anything we need to do on our end, do let me know.

Shah - the case is still with our lawyers/casework team to consider the ongoing contact and forms HR4/AP1 that have been submitted You aren't specifically mentioned in the applications so we can't share specific details with you.<br> I'd suggest you use our contact form to raise your concerns and to indicate what role you have re the titles/application as appropriate<br> <a href="https://www.gov.uk/guidance/public-guidance-dealing-with-land-and-property#contact-form">Public guidance: dealing with land and property - GOV.UK</a> <br> Otherwise I would expect the applicant to be contacted by the casework team once progress has been made

The solicitor who sent the AP1 form, along with my witness statement hasn't heard anything back since October either and that AFTER we requested expedition. Now Land Registry has a court order too and yet It seems all requests for an update or an answer are falling on deaf ears!

The other party was found be lying during court proceedings, hence they were asked to pay £6970 costs (very rare in family court proceedings and that too against legally aided party) It took us 6 months to get the court order to removed the homes rights notice only for the applicant to go and put on homes rights on one of other flats (WM902564) (auction cancelled due to pending application) I have objected to that already and will have to waste yet more money in courts to prove that the applicant is a serial liar and is abusing the family law, both in courts and by filing HR1 applications for properties she has nothing to do with and has never lived in them and have never been her matrimonial homes! It took HMLR 6 days to put the charge on my property (6 december 2024) but it has taken 14 months to just get an update (yet to hear back)to remove the notice - very unfair :(

Many thanks Adam - apologies you had to listen to all of the above but it's very frustrating. She is abusing the process and I feel she is getting away with it. It's both financially and mentally exhausting!

Shah - no apology necessary as expressing your concerns can sometimes help. I have spoken to the lawyer dealing with the matter at our end and she is fully aware of your concerns. However I am not going to go into detail on a public forum and/or try to unravel what is a complex scenario from our perspective. The casework team will shortly be writing out to the applicant to explain where the issue lies from our perspective and what needs to happen next. I do understand how you feel things are 'unfair' but the manner in which the applications have been submitted mean that there is still more to resolve from a registration perspective before a final decision can be made. Shah - because of the information submitted to date, in support of the objection made, the lawyer has written to the spouse to explain the registration position and given her until the 11th March to respond with more information/clarification if she still objects to the removal of the Notice. I appreciate that this is not what you were expecting/hoping for but in light of the comments made to date we have no choice from a registration perspective If she does not respond before the 11th March the register can be updated shortly after that date. If she still objects then the 'more' will be considered as appropriate. There is no need to respond here as this will have to run it's course before the register can be updated - simply wished to let you know that it has been actioned as far as we can WK103672
