I’m looking for guidance on the correct Land Registry process (procedural, not legal advice).
A spouse registered a unilateral Home Rights Notice (HR1) against a registered title. We became aware after it was entered on the register, and we submitted an AP1 application to challenge/remove the HR1. We also requested expedition several months ago because there was an ongoing Family Court case and the HR1 was central to those proceedings. The Family Court has now decided the application in our favour (occupation order struck out on jurisdiction / alternatively dismissed for lack of evidence; explicit judgement that spouse had no matrimonial rights to the property) and has awarded costs.
We are awaiting the sealed order, but will have it shortly.
My questions are: Once we have the sealed Family Court order, is it best practice to send the sealed order to be added to the existing AP1 application, so the AP1 can be completed based on that order?
Alternatively, should we submit a new application using HR4 (cancellation of home rights notice) supported by the sealed order? If AP1 is already in progress (and expedited), is there any advantage/disadvantage to filing HR4 as well, or would that cause duplication/complication?

Shah - as your application is still 'live' I would suggest submitting the additional evidence to be added to that application. The lawyer dealing with the matter will then consider/review the application further. Do speak to the conveyancer acting for advice/guidance also
