Good morning

A First Registration application was submitted on our behalf by our conveyancer on June 2nd last year, but we haven't received any correspondence on this matter since.

HM LR Reference is: KCA82C3

Please can you advise if there are any problems with the application that might be causing a delay, just in case?  This is the first time we have been through this process, and do not have any prior experience of lead-times etc.

Graeme - The application is caught up in the delays that we currently have and is awaiting to be looked.  Our average processing times for such applications are on our website 

If there is any urgency then you can ask for the application to be expedited - https://www.gov.uk/guidance/request-an-expedite

If there is no urgency then we would ask you to bear with us please.

Thank you for the information and the pointer.  In terms of the formal transfer we are happy to wait in principle, but are keen to make some changes to the plot that we have purchased in the meantime.  However, we would not want these changes to prejudice the outcome of any ownership assessments that the LR may wish to perform.

Is there anyone at the LR (or elsewhere that you can recommend) that we might be able to talk to about our application, to determine whether we can make changes now (for example, clearance of a long-collapsed wooden garage) if we take and record extensive photographic records?

In addition to this, the biggest issue with any long delay is that there are some old garages that currently form part of the sale, which we believe are in use by previous tenants of the vendor, who ceased payment of rent a very long time ago but have continued to use the garages.

We understand that the longer they have unchallenged use of those garages, the stronger their claim to those plots may become(?) so we would ideally like to come to a conclusion as soon as reasonably possible. Again, is there any chance you know of anyone that might be able to assist and recommend a course of action, if we could be looking at many months before our application is completed, please?

Graeme - we register the general boundaries so if you are making changes within those then they are not an issue for us when processing the application.
If the changes affect the boundary in anyway our advice is to always discuss and agree with your neighbour(s) as appropriate.
Someone's claim over land/property would not be impacted by how long for example your own application took to register. Your ownership is confirmed on completion and their claim would be based solely on their own 'facts' and the duration of time over which their claim had lasted. Our PGs 4 and 5 explain how applications to register such claims might be made but it is the legal complexities you need advise on and I would strongly recommend that you discuss those with a conveyancer as appropriate.
The first registration submitted in May 2023 is unlikely to be processed until much later this year but that should have none or very minimal impact on the issues you refer to and for the reasons as stated. Again something to discuss perhaps with a conveyancer for reassurance
