My conveyancer has requested my new build registration be expedited in early February, with the Land Registry website saying that the 'aim' will be to process within 10 working days.  I'm still waiting in mid April, and currently unable to move mortgages (having ported due to fixed rate fees), meaning I'm on a variable rate at a huge additional monthly cost.  How do I escalate this further as my conveyancer seems to be just getting a standard response of 'we will raise it with the case officer'?

Peter - expedition generally gets an application to the processing start line within 10 days. However if there are prior pending applications, and there often are with new builds, timescales will become stretched
What's the title number/case reference please?

Peter - many thanks. That's the developer/seller's title and your application is for Plot 2 it seems and provisional new title BM479087
I can see that processing has started and we needed more from the conveyancer in March but they have replied

Morning Peter - the casework team have gone back to the conveyancer to explain what's still required. Hopefully they can confirm for you and clarify what needs to be done and how quickly from their end

Hi again Adam. It seems my expedited application is being held back due to neighbouring properties' prior applications. Surely, the whole point of expediting due to financial losses is to prioritise. I don't know how long the neighbouring properties' applications have been in but, as the properties have been occupied since September, logic is telling me I'm still several months away (and many thousands of pounds out of pocket) from being able to secure a new mortgage. Is there any other way for me to escalate this?

Hi Peter - that is one of the issues yes but the casework contact explains 'more' for the conveyancer to consider/address as appropriate

Expedition and an urgency can't override that 'priority'
The ball is in your conveyancer's court to consider the contact made and address it as appropriate. That may mean contacting the seller/their conveyancer to resolve the issue as highlighted
Processing of the prior plot 1 removal is underway but that too has an issue that their conveyancer will need to resolve

Thanks.  It's in the hands of the Developers' solicitor so no control for me or my conveyancer.

Not your fault but crazy bureaucracy between land registry, mortgage companies and solicitors that I, as the owner and person paying a huge amount of money for a property, cannot prove ownership sufficiently to gain a basic mortgage product 3 months after occupation, and have no insight to how long I will continue to be paying thousands more than needed.

Peter - noted, fully appreciated and understood. It can be extremely frustrating in such circumstances. The lender, in my experience, holds all the cards re that mortgage approval based on the product being offered
Hopefully the developer can assist quickly as it seems likely that more than one plot have issues that their conveyancers need to resolve
Do post again once you have a positive update from your conveyancer and I can check with the casework team to see if matters can be progressed swiftly

Hi Adam,

I have been advised by my solicitor that the application queries have all now been responded to.  Please can you confirm that my registration is therefore progressing on an expedited basis.  I am now getting close to additional losses due to a soon to expire mortgage offer.

Hi Peter - they have replied but there are other prior applications still pending against the seller's title and they may still be impacting. I'll check with casework colleagues for an update for you

Thank you Adam.  I was anticipating that, as the replies had been received, an expedited request for financial reasons would take priority. Otherwise, I assume the ability to expedite is simply a gimmick.  Appreciate you looking into it and hope for a positive response.

And whilst expedition can appear to be a gimmick at times it is actually an absolute essential and must have that works extremely well when there is a backlog of work. However prior applications can and do impact on how effective expedition can beas in this case

Peter - the casework team have confirmed that the prior applications are impacting as they have the same issues that your own application/transfer revealed.
The rights granted/reserved weren't done correctly in each plot transfer so whilst your own conveyancer has remedied matters we are still waiting for those dealing with Plot 4 to do the same. I note that it's the same conveyancer re Plots 2 and 4 so hopefully they can clarify and assist you in that regard

Hi again Adam.  Solicitor has followed up with land registry as Plot 4's solicitor has confirmed the same issue does not exist in relation to that property (attached email).  Hoping you can add pace to a response on this.  Thank you.

Hi Peter - noted and appreciated. The conveyancer replied to our request late yesterday with an amended TP1. I assume their amendment removed the issue re the 'non existent' right referred to in the attachment you have provided
I have flagged their reply with the casework team and asked for a further update
