Application update

Good afternoon. Would you please be able to provide an update on an application which was made for first registration on a property my wife inherited. The origional application BM 485727 was made earlier this year, i requested that the application be expidited and was agreed as we accepted an offer on the house. The proposed buyer is keen to complete asap as they have been served a section 8 notice on their existing accomodation. A reqisition was sent by HMLR to our solicitor at the end of July requestion further information on 3 points including a conveyance going back to 1952 which by chance we found. We were informed by our solicitor that they responded on the 5th August. Could you please confirm that you have received the response to the requistion and if possible when the application will be completed? Many thanks

Kevin C - I'm afraid not. That will be shared with the conveyancer and you'd need to confirm and clarify the specifics with them as it's their application

Thanks, hopefully we can get these resolved quickly. You mention that further considerations will also be required even after the current request?

Kevin - the response is likely to include information that will then need to be considered by a senior officer to confirm the final registered information. As it's expedited that shouldn't take too long but next steps will depend on the conveyancer's response and hopefully they can explain that in more detail for you once the request is received and considered by them

Hi, appreciate your comments and help. It is difficult to find too much more information as the house was built in the early 50s as a council house and the late in laws were the 1st tenants and subsequently bought the house in 1979 but did not register it for some reason.

Hi Kevin - 1979 would probably have been too early and compulsory first registration did not come in for that area until later. Properties that have remained in the family for 40+ years can still be unregistered and very reliant on the original deeds as a result

We have the origional conveyance when the purchased it in 1979. As mentioned before,the casework team requested 2 conveyences that were not lodged going back to 1952, by chance we had a copy of one of them and this was sent to yourselves. Not sure why these were required ? Hopefully our solicitor will receive your request for more information today? Many thanks

Kevin - if we asked for older deeds I suspect it's because the later one(s) referred to them in some way re easements/covenants or more so we would have needed sight of them to confirm register entries needed. The conveyancer would have been told why in the request.

I can see why they are required but due to the date of them this would normally proove difficult to provide/locate even considering they were origionally built for the local council. All we were told was that the 2 deeds were required as they had not been lodged.
