Good afternoon, I'd like to check to see if an expedited application has been made to register a boundary agreement please. The address is 70 Kingston Road, BD10 8PD.

Thank you in advance.

Hi, are you able to let me know if the application has been submitted please? I need to chase solicitors if it hasn't.
Thank you.

Hi Adam, thank you for such a prompt responses on this thread.
The conveyancer is ghosting everyone (seller, buyer, other solicitors, EA), so nobody knows if the application has been made, hence my asking. It's the last piece of the puzzle before exchange and completion to there is a lot of anxiety and nervousness around this, hoping it will be sorted soon.

Can you let me know if anything has been received and if you can confirm if the registration of a boundary agreement can be done online or if it has to be submitted by post.

Thanks again in advance.

Bianca-Maria - nothing received against the title and if a conveyancer uses our business e-services then they can submit their application online.
If they don't then it's a postal application

Hi Adam, I hope you're well.

Can you please check again for me please?

Hi Bianca-Maria - submitted today. No request as yet to expedite so will flag with casework colleagues and ask them to do that asap
I must stress expedition is not a magic wand. It gets the case to the processing start line and applications to determine a boundary can be complex so it may still take a while to process/complete

Hi Adam

TYSM for coming back to me.

I will check with conveyancers about it being expedited.

The application should have been made to register a boundary agreement not apply for a boundary determination. Can you confirm what the application is for please?

Thanks in advance again.

Bianca

Bianca - they have referred to is a Determined Boundary in their application but as you state it is actually a boundary agreement

Will it be treated as registering an agreement or a determination? If a new application is required, let me know.

Thanks again for coming back to me.

Bianca-Maria - an agreement as that's what it is. A Determined Boundary requires a form DB and that's not been provided

Thanks again Adam, I really appreciate you explaining this to me.

I know my case won't be any more or less important that those that already exist in the system, however I just want to give you context as to why I'm so 'eager'.

I have an 11YO daughter who is currently waiting for the exchange and completion of the sale/purchase so we can confirm what school she will go to in September. I couldn't apply earlier in the year for local schools to the new address because they need proof of address to make an offer. She is in Y6 and will be going to secondary/high school in September. At the moment, she doesn't know where she's going and it's tricky to manage her when everyone else she knows has a place and is excited about transition trips. There have been considerable delays in the sale/purchase process which has caused us to reach 6 months in progress.

It's already a stressful enough process with all of the delays caused, the school situation is just another layer.

I really hope this is a swift process so I can get her sorted.

Bianca-Maria - expedition is the 'fastest' way of ensuring something is processed. But it's not a magic wand as essentially it gets it to the start line for processing. Everything then hinges on whether their application is in order or not.
Boundary agreements are relatively simple to process if they are in order as they are simply noted on the affected registers. But the big Q is always are they in order and until processed we won't know
There's no extra level of urgency based on specific personal circumstances I'm afraid but I will keep an eye on it to save you posting every day for an update

I understand, thank you for being so clear in how the process works. Are you (or I) able to request the application be expedited if it hasn't been already? My solicitor said whoever is submitting the application needs to wait 24 hours after making the initial application before requesting it is expedited?
This is the last piece of the puzzle before exchange and completion, hence why it should have been requested.

Bianca-Maria - it has been expedited already on 14th May as I flagged it with colleagues due to your own urgency
our solicitor is correct re submission first and request expedition second is the way to do it but they wouldn't have to wait a day before doing so
You now need to trust the process and hope everything is in order.
Suggest you post again after the weekend and we can see if there's an update to share. There may not be but fingers crossed for you
