Hi 

My solicitor wrote to you in August re the above.  Although there was an expedite request we understand that this is being held up as there are 12 o/s applications on the title AA28838 which are new build flats.
 
Application ref D065FHT affects titles EX898977, EX620028 and AA28838. 
 
Application ref X979GHT affects titles EX898977 and EX620028. 
 
D065FHT has priority on titles EX898977 and EX620028, however it is being held up from processing due to a large number of prior pending applications lodged on title AA28838, where it is currently 13th in the queue.
 
Unfortunately, in the case of multi-title applications, a delay to processing on one title will necessarily also hold up processing on all the attached titles. This means that until all the prior applications on AA28838 have been processed, we wil be unable to proceed with either D065FHT or X979GHT. 

Have any of these since been registered and are they being expedited?

We are now about to lose another sale because of this it is incredible stressful.   Any help you could provide would be great.

Hi Kathryn - the title delaying matters for you is AA28838 where there are a dozen prior applications, all to register new lease purchases, that need to be processed as they have 'priority' with regards the order of registration 
Whilst a prospective purchase has clear sight of what is already registered and pending I assume there are reason(s) as to why they are unwilling or unable to complete without the registered title(s) being 'clear' or at least the Deed registered against the affected titles.
I will check with the casework team to see what they can do to assist

Hi Adam

Many thanks for your prompt reply.  The prospective purchaser is borrowing money to complete the purchase.  He has said that his lenders solicitors will not release the funds until the pending applications are complete.  Since we were selling to him as an unconditional purchase at a lower price in return for a quick sale this is very stressful news for us having already had one sale fall through because of this matter.  My mother who is 90 owns the land and this is impacting her mental health.

Any assistance the casework team could provide would be brilliant.

Hi Adam,

Sorry to chase again so soon but I wondered if you’d had any update from the Casework team.  We were chased again by our buyer’s solicitor yesterday who is getting impatient and I don’t think I can face another sale falling through after 3.5 years of trying to sell this property!
Any help you could give would be appreciated.

Hi Kathryn - no apology necessary and apologies form me as no update as yet. I will ask again but I am conscious that the reasons for delay are multiple and the complexity of the type of applications in the way of progress makes it difficult.
I will post again once I have something definitive to share

Hi Adam,

Thanks for getting back to me and asking them again.
I know I'm clutching at straws but is there anyway our expedited application can be given priority over the 12 ahead of it since they are completed sales of the flats and not having any adverse impact on the owners of AA28838 whereas ours not going through is rendering our property unsaleable?

Hi Kathryn - I can't be definitive re timescales and as you will appreciate those being asked to carry out such a review are also being asked to process as many cases as quickly as possible. 
I will share an update when I have one and try not to get too distressed around something which is outside of your control.

Hi Kathryn - the casework team advise that we are still stuck between a rock and a hard place with the pending Deed of Release and the prior applications to register new leases out of AA28838
They have hastened the prior new leases as far as they can but most have outstanding requests for more information to be provided. The missing information appears to be fairly administrative in most cases and a common conveyancer involved also. Hopefully therefore that conveyancer will be able to respond swiftly to enable the applications to be completed.
The hard place we have to deal with is that we can't release the AA28838 from the rights/covenants referred to ahead of those leases being registered as they are affected by the Deed based on when they were granted/sold which was ahead of when the Deed of Release was completed. The priority order then created re submission of each application then impacts as well.
So as things stand we have 9 pending new lease applications still ahead of the application to register the Deed of Release and we must clear those before being able to update AA28838 fully

Hi Adam,

Thank you so much for getting back quickly and for getting us this far.  So at least 3 of the pending applications have been completed!  Does that mean for the remaining 9 that the conveyancer has been approached and the casework team are awaiting their response?

Hi Kathryn - There are still outstanding points and a request for information was issued on 13 November for title EX620028. These points will need to be resolved before we are able to complete.
