RX4 expedited

The following RX4 was logged and then recently expedited Application Reference: U104DVT Title Number: SY547567 We have been told it’s now with a senior officer for guidance on one or more technical point . My husbands brother ( the person who is named as putting restriction on ) put in this application as we wish to sell the house but want the restriction off . Can you advice on the current status of the application and also can further supporting comments be sent in by the applicant in regards to the RX4 and how to do this . If they will be contacted for further information . The situation is that the restriction was put on as the mother wanted both brothers to live together but the brother who has put the restriction on in the documents has no interest in the property he has never contributed financially or ever lived in the property and now we want to sell has sent in application to get the restriction lifted.

Tehmina - the application you refer to was cancelled on the 12th February. There are no pending applications against the title

Tehmina - the restriction was never registered. The application to add it to the register was cancelled on the 12th Feb.

Maybe he sent in the wrong application . Can you please correct us , there is a restriction on our property by Pervez Mustafa that we cannot sell without his permission . An RX4 was sent in by Pervez Mustafa to get this restriction cancelled / removed . Is the RX4 the correct application for this . As that means the restriction still remains in place

Tehmina - I may have confused matters in my earlier post as I saw that the application has been cancelled and wrongly thought it was to register, not withdraw, the restriction. The applicant withdrew their own RX4 application causing it to be cancelled. The restriction remains on the register.<br> If you consider that it should be cancelled, as the restrictioner will not withdraw it, you should apply to do so using form RX3 plus supporting evidence as appropriate<br> I would recommend discussing with your legal rep as appropriate<br> SY547567

Thank you for your help we will now apply using an RX3 form as Pervez Mustafa has had no financial contribution or has no legal interest in our property
