Hi,

My family are changing the ownerrship of the family home from my mother and father (now divorced) who are join tenants to myself (son) and mother (I'm buying my father's share in the property) as tenants in common (50/50 split). 

The property has not yet been registered (last sale was in 1972).  I understand that we need to fill in both FR1 and TR1 (with DL as well, of course).  TR1 is ready to sign/etc.  My question is about how we fill in FR1.

Do we fill in questions 6 (applicant) reflecting the current situation - ie, with the names of my mother and father (current owners) or the position we're transferring to - ie, myself and my mother?

Correspondingly, do we fill in question 9 (join tenants vs tenants in common) reflecting the current position or what we're transferring to?

Hi John - panel 6 of form FR1 should name those who will be registered as the legal owners
Panel 9 should be completed according to how said applicants wish to hold the property

Thanks Adam - so I'm reading that as FR1 should be filled in with the details of how we want the transfer to be upon completion, rather than how they currently are before the transfer.

John - correct. You are applying to register the property for the first time and in the names of the people who will be the legal owners. Not who used to be
