Hi

We believe our solicitor submitted an expedited adverse possession application on our behalf on 15 September as we'd discovered when selling our property that our driveway and the top of the garden wasn't included in the title (after living here for 23 years!). We were told it would be a straightforward process as it looked as though an error had been made at some point, given that the boundaries of all other properties on the street end at the public footpath.

Would you be able to give us an update please? The title no is DU175514.

Thank you for your time.
Hi Julie - nothing showing re an application to register the land at the northern end of your property. If they have lodged such an application then they should be able to quote the provisional title number and our (ABR) reference - worth asking them to confirm those details for you to be sure and I can check again
Whilst it can be a straightforward process, provided the application is all in order, it is still likely to take time to complete even if expedited - Adverse Possession - Claimed Land - Impact on Timescales · HM Land Registry
DU175514

Hi Julie - many thanks. That's an application against DU175515, which is #33 in the road.
It was submitted on 19th Sept and expedited on 9th Oct. It's now waiting to be processed by the casework team. That should happen in the next few days and everything then hinges on it being in order and what next steps are required
Next steps invariably involve a site visit/survey and wider checks with the registered owner of the land being claimed. They will take time if required and hopefully your conveyancer has explained this to you
I'd suggest asking them to confirm if the claim is with regards the land registered to next door or if it should in fact be an application to claim the unregistered land immediately to the rear of your own title
DU175515 - J140ZZT

Thanks Adam that’s really helpful. Not sure why it’s registered against #33 as the claim is for the unregistered land immediately to the rear of our property. I’ll go back to our conveyancer and ask the question.

Hi
I spoke to our conveyancer and they said the Land Registry requested a further form be sent in the post as the land in question is currently unregistered. This was form FR1, an application for first registration and was sent approximately 3 weeks ago. They also said once receipt of the application had been acknowledged they’d contact you about the mix up with no. 33. Could you please let me know the current status of the application and approximate timescales? As they’ve had to submit a FR1, is this treated as a new application and we’re back to square one again?
Hi again Julie - that's correct as their original application was flawed. A new one was received on 22nd October and that's now waiting to be processed. It is treated as a brand new application as you state
Unfortunately, they have not as yet requested expedition for it and I'll flag it with the casework team to do that based on the original application/request.
Even with expedition this will take time to be processed/completed - this thread offers an idea of what to expect and possible timescales - Adverse Possession - Claimed Land - Impact on Timescales · HM Land Registry
DU403524 - provisional title

Hi Would it be possible to have an update on this application please. We were informed by our conveyancer in December that the application had been “finalised” and they were just awaiting the completed paperwork. Is that right? Many thanks

Hi Julie - wider checks now underway with adjoining landowners. Those may not expire until shortly after 5th March. Hopefully nearing the 'end' of the registration process. DU403524
