Hiya

My parents were tenants in common on a property worth £440,000.

My mother has left me her half of the house in her will.

I've been advised to fill in TR1 and AP1 - but I can't see anywhere that definitively tells me what fee I should be paying. I'm presuming it's scale 2 fees - but is it £100 or £45? I'll be making a postal application.

Thanks

Hi David - I assume your Mother has sadly passed away and the intention of your Father/You is that the property is transferred into your new joint names. If so then the fee is payable under Scale 2 on half the full market value.
Complete form AP1 panel 4 to refer to the 'Full market value £X" and pay the appropriate Scale 2 postal fee.

Hi Adam

Yes, she has passed away unfortunately.

So looking at the scale 2 fee - half of £440,000 would be £220,000, so I assume the fee is £100 (by post?) Is that the whole fee? Nothing else to add? The intention is indeed to transfer it to my father and I.

Thanks

Hi David - £100 is the correct fee. You can only apply by post

Hi
i am making an application to have my ex wife taken off my Property. We settled our separation in 2000 to about 55,000
but we never change the deeds. I am looking to get this done as she has remarried and this needs correcting we are fine with this. And I was not sure what fee I should use when sending AP1,TR1 and 2 ID1 and copy of new wedding cert.

Would be grateful for you help.

Thanks

Hi Andrew - if there is a financial consideration involved then the fee is often paid under Scale 1 on that amount. However if that's not the case then it is paid under Scale 2
See our online guidance re fees and the examples included to help you calculate the fee - HM Land Registry: Registration Services fees - GOV.UK

Hi Adam

Thanks for that both scale 1 and 2 to show £45 for post applications so it does not really matter?

Andrew - it matters in so far as the casework team will need to know the specific details on which the fee has been based.
If it's a Transfer with an actual consideration of £55K then that's where your Scale 1 fee generally comes in

Hi Adam

Had trouble phoning. just a quick one. If we are divorced and  agree on transfer with  no money or anything that has monetary value. Market value of house around £300,000 with £0 fee. What would be the scale2 fee?

Thanks

Hi Andrew - if the transfer is from the two of you to just one and no monetary consideration, then the Scale 2 fee is payable on half the current market value
Complete panel 4 of form AP1 to refer to Transfer 2 to 1 - Full market value £300K - pay the right fee
