Hello,

I am in the process of transferring the title deeds for the house I live in, from both me and my ex-partner's names on the deeds to mine alone.
No money is changing hands, and the property is not being sold - we have completed ID1 and ID5 checks, TR1 and AP1.

I am almost ready to send in the paperwork, but I know there is a fee to pay.
Please could you confirm:
- will it be scale 2 fees
- how accurate does the property value need to be? I can make a rough guess based on what almost identical properties are being marketed for, but have not had estate agents round to value (and their valuations are subject to their own forces anyway)
- do I send a postal order in the envelope with the application?

Hello Naomi - Scale 2 is correct and it is payable on half the current market value. Scale 2 has quite broad value parameters so fit the half value within those for the correct fee.
When completing panel 4 of the form AP1 state Transfer 2 to 1 - Full market value £X  and then pay the required fee by cheque or postal order

Could you please also clarify what I need to write in Panel 6 (applicant)? I am gifting my part of our house to my wife: do I need to state only my name or both our names?

Hi M - so you are transferring the property/title from your sole name to two names, you and your wife. If so then you are both the applicant as both names will then appear on the register as joint legal owners
However if you are doing as the OP and removing one of joint names then you need to put the name of the sole owner to be/transferee as the applicant in panel 6

Hi Adam,

thank you, sorry, my fault for not explaining well

The house is currently in joint names. I want to transfer my part of the house to my wife. Does that mean the the applicant in panel 6 (AP1) is my wife (who will own the whole property at the end of the process), i.e. the transferee?

Also, the TR1 panel 4: who is transferor in this case? Is it only myself (because I am gifting my share of the house to my wife) or is it both of us because both our names are on the title register at the moment?

I suppose panel 5 on the TR1 (transferee) is only my wife

HI M P - if your wife is going to be the sole legal owner then yes re her name in panel 6 as the transferee
For panel 4 of form TR1 you are both the transferors. You can't transfer a share of the legal ownership so if you are both registered as current owners then you both transfer the whole of the legal ownership to just your wife. You are both transferors and she is the sole transferee

AP1 panel 14 (2): do I need to check the second box (i.e. provide evidence of identity for unrepresented transferor and transferee)?

M P - yes. You will need to provide identity verification in forms ID1/ID3 as appropriate.
