<p data-end=428 data-start=131>The deceased left a Life Interest Trust in his Will for the benefit of his spouse, covering his 50% share of the main residence. We need to update the Land Registry to reflect that the Trustees of the Life Interest Trust now hold a 50% share, with the remaining 50% owned&#160;by his spouse.</p> <p data-end=494 data-start=433>Which Land Registry forms and documents are required to effect this change<br> <br> Many Thanks for your assistance</p>

Umesh - we register the legal ownership and that is always transferred as a whole. As such if the property is to be transferred then we need the usual forms AP1, TR1 and ID1s as appropriate<br> The key is though how the property is currently registered and whether you want/need to transfer the legal ownership or whether the trust created can be or is protected in some other way -&#160;<a href="https://www.gov.uk/government/publications/private-trusts-of-land/practice-guide-24-private-trusts-of-land">Practice guide 24: private trusts of land - GOV.UK</a>&#160;<br> You have to decide what it is you wish to do and that's unclear from the information shared&#160;

<p>Dear Sir</p> <p></p> <p>Thank you for your prompt response.</p> <p>The property is currently held as Tenants in Common between the deceased and his wife. We now wish to transfer both the legal and beneficial ownership of the property equally to the deceased's wife and the Trustees of the deceased's estate.</p> <p>In addition to completing forms AP1, TR, is it necessary to complete form AS1 in this situation</p> <p>Thank you very much for your assistance.</p> &#160;

Umesh - the Transfer would be by the surviving owner using form TR1. Form AS1 is only used where an executor is transferring the whole legal title to a beneficiary for example. That's not what is happening here
