hi there. I am the administrator for my mother in laws estate. The house she left is to be split three ways and one of the siblings wants to buy the others out. This fee has been arranged, the house has no mortgage on it so it's a simple transaction . I need to 'sign' the house over to her and i'm thinking that I'll need to use for ID3 for both of us, AS1 to assent the property over to her and AP1 to change the register. The land registry already has been informed of the death and that I am the administrator of her estate. Please help, I'm in bits over this because the land registry won't enter into any discussion about it! thanks in advance!

by the way I have read all the guides and watched the videos but I'm still wanting clarification. we don't have the money for a solicitor as one has just completely ripped us off and we don't trust them any more.

Hi Annemarie - I am unclear on precisely what is that asking for help. With regards to the transaction, since one of the sibling is buying out the others, i.e. some kind of monetary transaction taking place, then the form AS1 would not be the correct. Form AS1 should be used when the property is being assented to the beneficiary of the deceased person. You would need to use form TR1 accompanied by the form AP1. This would have to be accompanied by an official or certified copy of the Probate and evidence of identity for all the parties involved. You also mention "...use form ID3 for both of us..." but before that refer to the title being split three ways. So what about the third party? I would point out that we can only provide guidance on our procedures. We cannot help with any legal guidance as that would be going beyond HM Land Registry's remit. What you are aiming to do may require some legal guidance.

Hi, thanks for your reply. So the three parties are included on form TR1 with form ID3 for each of them? We are then sending AP1, TR1 and three ID3's? Along with the original letter of administration. Does that mean that even though I am the administrator of the estate the 'Transferor' is myself and the other sibling?

flower foto - the transferor would be whoever is named in the letters of administration. I read that as being just You. The transferee would then be whoever the legal ownership is being transferred to and again based on your post that would be the sibling buying the others out. The bought out siblings have no role to play as beneficiaries so you need AP1, TR1 and ID3s for yourself and the new legal owner. Plus a certified copy of the letters of administration - please don't send the original
