Hi,

My wife and I are executors for my father-in-law. His property goes to my mother-in-law (mortgage all paid). However, as the house has never been registered, we need to complete forms FR1 and AS1.

I have looked at Practice Guide 1; first registrations but still had a couple of queries regarding FR1 that I hope someone can help with:

Panel 6 (the applicant): Is it correct we put my mother-in-law's name here?

Panel 7 (the application sent by): My contact details?

Panel 8: Tick 'the address of the property ...' as that is where my mother-in-law lives?

Panel 10: Leave blank?

Panel 13 (examination of title): Tick this box?

Panels 14-16 (confirmation of identity, etc): Please could I get some advice on how to fill these panels?

Hi David - I assume from your post that your FIL was the sole legal owner.
Panel 6 - correct as the 'applicant' is the person to be registered as the legal owner
Panel 7 - correct if you are the one submitting the application
Panels 8, 10 & 13 - correct
Panels 14 &16 will need completing as appropriate and identity verification provided for all three of you. It is a compulsory first registration as you are transferring the ownership to your MIL

Thank you so much for your quick reply - it's a great help.

Just a follow-up with regards to Panels 14 and 16. 

Panel 14: A tick in the box 'I am not a conveyancer...' seems straight forward enough.

Panel 16: Looking through some of the guidance I'm wondering if the following would be correct:

Section (1) Details of conveyancer acting

Under the column for 'Name of transferor ...' - in the first row we would put both my wife's name and my name as (transferors) and in the corresponding second column our address.

Then on the next row we would put my MIL's name as (transferee) and insert 'None' in the corresponding second column.

Section (2) Evidence of identity

Would we just tick the first box?

And as a follow-up, would we need to complete form ID3 for all 3 of us? Or is this not necessary?

Panel 17 - My signature (or my wife's signature too) and date?

David - you would list your names individually in each row/box and None in the final column against each also. Not your addresses
You then need to provide evidence of identity for all three of you so ID1/conveyancer or ID3/others as listed. One each.
As it's you and your wife applying then you would both sign and date the form

As my wife would also needs to sign in Panel 17, would we need to enter my wife's name in Panel 7 in addition to my own?
