We are trying to sell house we have built, there is an error either in the title plan or os map. We have used the measurement from the title plan to install the fence. This has been an issue now for 3 months. Initially we did put the fence in the wrong but we have moved to what we believe is correct. We have gone through it with the land owner as well. Who also thinks it’s in the right position. Please can you help as we don’t know what to do and it’s holding a sell up of this new house

William - sorry to read that. OS details reflects the physical features in place when OS last surveyed the area. They don't denote ownership. The title plan denotes the registered extent and ownership alongside the register. Provided the title plan matches the reality on the ground there is no registration issue.

The issue it doesn’t. We moved the fence, using measurements from the CAD drawing, but land reg still say we out on the ground by 1.5m. Both the myself and land owner are happy with the location of the fence but you guys aren’t. I don’t know really what to do, I show the the differences if you want

You are saying we out my title boundary and on the land owners. But myself and land owner agree we think we have put the fence in the right location, according to the measurement from the dwg which the title plan was created on

William - a phone call will never resolve such matters. If you are selling I would recommend discussing it with your conveyancer and if there's an issue for them to contact us as appropriate. If there's a reason for not doing that then contact us direct using our contact form and explain what the issue is.

We have just found this afternoon from the buyer when they did there os2 search came back

William - if I have identified the phone only records from you correctly the issue lies with the plans being used by you/your buyers re the development involved. Using plans that don't match current OS detail will always cause an issue and something for a developer to resolve with OS as early as possible. I would recommend contacting OS to request a site visit/survey by them to update the OS detail for the site.

We have used an as built drawing to send them, which matches with the os map. But land reg are saying it’s out side our boundary. We have used the document which created the land reg document to get the location of the fence

William - I'm really sorry but I am struggling to understand what you are referring to. If it relates to your phone calls re ST388648 then you need to speak to your legal rep to consider what the issue is. The plans being used for that site do not match the OS detail but your posts suggest there is something more involved that I do not have sight of.
