There is a Registered Charge in our names on our son's property, and a restriction on disposition of the property. We now wish both to be removed, so our son will be sole named proprietor, without restriction.  I'm unclear about what forms to use in these circumstances, so advice would be much appreciated.

Kay - forms DS1, DS2 and ID1/ID3 as appropriate

You will need to send us:

  • Form DS1. This should have been completed by the lenders

See Practice guide 8: execution of deeds for information on how to execute the form DS1

  • Form DS2 (sometimes form DS2 is printed on the reverse side of a DS1). When you have completed form DS2, you need to send it along with the completed form DS1 to the address shown below.

Evidence of Identity is usually required for all parties to the transaction unless they are represented by a conveyancer. See Practice guide 67: evidence of identity for more information and the options available to you.

You will also need a form RX4 to withdraw the restriction
There is no fee for this application.
