I am assisting a parent to remove a first and second mortgage from her registered leasehold title. The freehold title is unregistered.
i have endeavoured to contact national Westminster bank and national dock labour board to see if they can complete the form required. The bank cannot trace the account as we have no bank account number and the board has no records of the loan.
both institutions issued and signed a form 53 in November 1987 and we have the original of these and the original charge certificates and mortgages sewn up the charge.certificates.
please can you advise which forms need to be completed as I understand the registrar has a discretion under the rules to remove theses charges under rule 114.
please also advise  what evidence of identity needs to be given for national Westminster bank and national dock labour board
please can you clarify which forms need to be completed

Nicole - you should apply using form AP1 and submit that along with the form 53s and, if you don't wish to retain them, the charge certificates. The certificates will be destroyed and not reissued as they have no legal relevance any more.
The form 53s are the 'older' way of discharging legal charges and should have been submitted to us at the time although I suspect either the lenders did not make that clear or your parent was unaware. 
There's no discretion involved here as you have the Form 53s as evidence of discharge
I would complete the form AP1 with the appropriate details and include a letter explaining why, to the best of your knowledge, the forms (and CCs) were not submitted at the time

Good evening Adam 

thanks for the reply . I forwarded it to the lawyers dealing with mums application and it appears that they did not follow your advice and send a covering letter to explain the reason for late registration as the land registry advised that they could not accept the forms 53 sent and asked the lawyers to do it on the online portal which they advised me they could not do as they could not verify the identity of the charge holders.the lawyers have gone back to nat west and Nat west have agreed to discharge on their side. However we are in great difficulty with national dock labour board as they no longer exist.

i would appreciate your advice as to how to proceed the title number for the registered leasehold is WA124906

Good Morning NIcole - the primary reason that the matter was cancelled was because they did not apply correctly, namely using a form AP1. 
If NatWest are going to discharge their own legal charge then I would suggest leaving that to them to complete
As for the National Dock charge we need a completed form AP1 (application form) and then the supporting evidence I referred to

Good morning.

i heard from my mums lawyers that they have resubmitted the form AP 1 .

however I believe they have only sent a copy of the form 53 and not the original. Please can you advise if the original is required?

also is the original charge certificate required? If so please let me know and I will get them to send originals.

Further  in their covering letter they did not state the reason for later registration the reason being that my mum retained them at her home since she received them from the national dock labour board .

Hi Nicole - The copy form 53 has been accepted and wider checks are now underway which involves attempting to contact the chargor. Those checks expire after 4th December 2024 unless they respond positively to the notification before then.
