I'm buying a property that contains a house and an access track within a single registered title. The track provides access onto other land I own, not access for the house itself. Some time after registration I'll probably want a mortgage on the house but I don't want the track to be subject to any charge. Lenders are unlikely to take a mortgage over part of a title, so the track has to have its own title. My understanding is that you'll only usually split a title on a transfer of part, so if I'm registered as proprietor of the whole the only route would be to transfer the track out to a company or a joint holding and take it back, which I'm not willing to do, as I want to remain sole proprietor throughout. So the split has to happen on this purchase. The seller is happy to do two transfers on the same day, i.e. a TP1 of the track and a TR1 of what's left. Can the TP1 and TR1 both go on one AP1, listed in panel 4 in that order, or are separate AP1 forms required for each transfer? If it's one AP1, do I tick panel 3 as whole or as part since the TP1 affects part and the TR1 affects what remains after that, but ultimately the whole of the title is affected? If separate, do I need to include identity verification documents and certified copies of the same SDLT5 for both applications or just once? Both sides are doing this without a solicitor and I am only asking for help with the AP1 to minimise the possibility of any requisitions, not requesting legal advice.

S B - you can do a single AP1 for both transactions. Panel 4 should refer to Transfer of Part and Transfer of Whole in that order. Panel 3 can be amended as appropriate to state both Part and then Whole of remainder for example HMRC will provide you with the appropriate certificate(s). Just need to make sure whatever they provide refers to both transactions as appropriate. One application so one set of identity paperwork for each party involved as they are identical for each transaction Appreciate both parties not using a conveyancer but please do consider doing so for such an important matter.
