ive been left an equal 3rd share of my late mums house along with my 2 sisters,i was living with my mum at the time of her death and am buying one of the sisters out of their share,my other sister is giving me her share as i will be leaving it upon my death to her children. We have done a deed of variation to vary the will and been granted probate of which i am the sole executor. I would now like to transfer ownership of the house which was solely in my mums name to me.Can you tell me the correct forms i need please,is it TR1 and AP1 and then do i need an ID1 just for myself or for my sisters too?.

Hi Adam,i have looked at the guidence but found it confusing,at first i thought i needed an AS1 rather than the TR1 but then i looked at this forum and was even more confused as to what the right forms were.Any help would be appreciated.Thank you

Hi Richard - sorry to read that. From a very basic standpoint form AS1 is used by an executor to transfer the ownership to a beneficiary. Any other transfer would rely on form TR1 instead. In your scenario, as we are not privy to the will or wishes of those involved for example, you can use either as you are transferring as the executor to yourself. You would use forms AP1, TR1 and ID1/ID3 for yourself only in such a scenario. You don't need ID1/ID3 for the sisters as they are not directly involved in the transfer/application Whilst you don' have to I would strongly recommend seeking legal advice/assistance to consider the thinking behind the gift, the share being bought and your own will. Tax advice re IHT and CGT would also be recommended if not already sought
