My pension scheme (SIPP) owns leasehold of a building. The title shows a lease that expired some 5 years ago. That lease is being renewed and as the renewal lease needs to be registered at the Land Registry I have been advised to have the previous lease removed (otherwise the Land Registry will register both leases as concurrent leases). First question - will leaving the expired lease on the title actually cause any problems? Second question - how do I get the expired lease removed from the title? What forms do I need to complete?

Chris - it doesn't cause any problems from a registration perspective. Form CN1 if it's a noted (not registered in own right) https://www.gov.uk/government/publications/leases-determination-pg26/practice-guide-26-leases-determination

The expired lease is registered and the new lease will also be registered. Still no problems from a registration point of view? If I did want to remove it, guessing CN1 would not be the correct form to remove a registered lease?

Chris - form CN1 if the lease is noted. Form AP1 if it is registered under it's own leasehold title. The PG 26 gives you guidance

I have looked through PG26 but cannot see the specific section that instructs the use of AP1. Could you point me to the relevant section please? Also, is it just AP 1 that I use or are there any supporting forms?

Chris - section 2 refers to how to apply where both interests are registered. It doesn't specifically refer to form AP1 but that's the form to use when applying to update registered titles. You then need to consider how the existing lease is being determined (closed) and how the new lease is to be registered. For the new lease PG 25 comes into play and you can use the same AP1 to submit both types of application as appropriate - https://www.gov.uk/government/publications/leases-when-to-register-pg25

Whilst you don't have to use a conveyancer we would always recommend that you do as they are familiar with the forms and process and can offer specific guidance as to how the old lease is determined and the new one can be registered
