Hi Adam,

Background:-  My husband died a couple of years ago.  We were tenants in common with 50% share each.  I am now trying to update the ownership of our property.  There is no mortgage involved nor money changing hands.  He died intestate so I am the sole beneficiary of his estate.  I have letters of administration already.  

i have completed an RX3 and ST5 and trying to complete AP1.  Having looked through all the guidance and now more confused than ever.  I have entered my name in panel 6 as applicant but when it comes to panel 14 I am at a loss as to how to complete it since all the advice suggests the transferor cannot be the same person as the transferee.

could you also please tell me if I need to complete any other forms in support of my application.

Hi Marilyn - it's forms DJP, RX3 and ST5 you appear to need here as there's no 'transfer' of the legal ownership involved
As you were joint legal owners the legal ownership passed to you following the death
The 50% share/tenants in common relate to the beneficial ownership, presumably protected by way of a form A/joint ownership restriction on the register hence the forms RX3 and ST5 you refer to

Thank you. I have completed a DJP as I picked it up from one of the guidances just wasn’t sure I would need it.

Are you saying I don’t need to complete AP1 then?

Hi Marilyn - if you are updating the register re the death then that's form DJP which is a standalone application form that can be submitted along with a certified copy of the death certificate plus the forms RX3/ST5 as well.
Form AP1 would only be required, and not form DJP, if there was 'more' being applied for
