I want to remove a legal charge on a property because the loan (not a mortgage) has been repaid. The conveyancer who originally acted for us said it's not too difficult and that I need an AP1, an RX4 and an ID1 for each of the lenders (me and my wife). The ID1 says "you MUST (my caps) get a conveyancer to verify identity". So should I use an ID3 instead and get a friend who's a Chartered Accountant to be verifier?
On the RX4 in section 11 there is only room for one signatory, but we are joint applicants which seemed fine for the AP1. How do we do this?

Colin - if you are applying to remove a registered legal charge then you will also need a form DS1 completed by the lender/creditor
Form ID1/conveyancer or ID3/others as listed for the lender/creditor and/or whoever is applying (if different)
Panel 11 can be signed twice and dated. It's then read in conjunction with panel 12 as well

Sorry Adam, I wasn't clear. I and my wife are the lenders and the money has been repaid to us. So do we need a DS1 or an RX4 ?

Colin - if it's a registered legal charge then you need a form DS1. If you also registered a restriction linked to the charge then we also need a form RX4

Hi Adam - thanks for that. I've just looked at the Official copy of the Title on the Register sent to me after the transaction was done and there is a Restriction under B: Title register and a Registered Charge under C:Charges Register. Both have the same date.
So now I think I need to complete and send (in one batch) AP1, RX4, DS1, ID3(me) and ID3(wife) with the ID3s verified by a friend who is a working CA. Does that make sense?

Hi Colin - that makes sense

Finally getting to filling the forms in and DS1 and RX4 seem straightforward as does the ID3. The AP1 not so much so I have a few questions if I may. The context remains the same; us as the unrepresented lenders applying for the removal of both the legal charge and the restriction. In preparation for making this (hopefully) a one-shot query I have entered them in a Word table which I will upload if that is OK. Please let me know.
Thx
Colin Wall

Colin - form AP1 should be completed re panels 1-7 inc, 12, 14 and 15. We don't pre-approve forms for submission so please rely on the accompanying side notes on the form and the online guidance as to how to complete each form before submitting your application

Hi Adam
I've been reading a few posts which seem to say that if a registered charge in Part B and its restriction in Part C are both dated then only the charge needs to be removed using a DS1 and the restriction will automatically be removed with it.
Is that correct? If so I'm reduced to AP1, DS1 and 2xID3. The title in question is EX332568.
Thx
Colin Wall

Hi Colin - that is correct. The restriction was applied for within the body of the legal charge (form CH1) itself. As such the B reg rxn and C reg legal charge are linked so when the charge is discharged the rxn will go with it

Adam this may be the last question (you wish).
On the AP1 Panel 4 what is the correct wording.
Is it "Cancellation of a registered charge" or "Discharge of a registered charge" ?
Or, indeed, is it something altogether different ?
Thx
Colin Wall

Colin - "Discharge" will do
