Hi there, I've had a read through this forum and there is some great information, so I just want to ensure I have things right. I am trying to help a friend who's mother recently passed away. My friend is the executor and sole beneficiary of her mother's estate. They are currently applying for probate. My friend had a charge on her mother's house (she lent her mother some money to buy the property). The property is solely in her mother's name. I believe we need to submit a DS1 (as my friend was the lender), DS2 (as my friend is the executor and also sole beneficiary) and also ID3 (my friend will get her doctor friend to witness it), to remove the charge? We will also need to submit an AP1, TR1 and ID3 to transfer the property in to my friend's name? Can all the forms be submitted at once? If so, can we submit just the one ID3? If they have to be submitted separately, do the DS forms need to be submitted first? In the relation of section 8 of the DS1 form, are there any examples/guidance as to suitable wording/format for this charge being a loan by my friend (I'm not sure what to put in this box)? Hi Jay - all largely correct but you can use just the AP1 as the application form for both Discharge transfer. As the transfer is by executor to beneficiary strictly speaking the correct transfer for is form AS1 and not TR1. See PG 8 for guidance on how a private individual should execute both a DS1 and AS1 for example https://www.gov.uk/government/publications/execution-of-deeds/practice-guide-8-execution-of-deeds

Hi Adam, Thanks for the very quick reply. So just to confirm, I can submit a DS1, AP1, AS1 and an ID3 form all at the same time? I just checked the DS1 guidance link you provided and the DS1 form again, I originally thought I had to provide specific wording to state the property is no longer charged, etc. But it appears I only need to provide the "normal" execution (signature, witness signature, name, address and associated wording).
