Asked to remove a unilateral notice in respect of an equitable charge - which form to use?

Hi, I work for a firm of solicitors. We registered a charging order on the property of one of our debtors due to an unpaid invoice. The debtor has now paid the charge and we have been asked by solicitors wishing to sell the property, to remove the charge from the register. We have been asked to complete a UN4 or DS1. I do not believe the UN4 is the correct form as we do not own the property. From my research it is unclear whether we need to complete a UN2 or a DS1. Please can you confirm this? Thank you

Hi Rebecca - if it is a Unilateral Notice and you are the beneficiary or act for them then form UN2 would be the form to use. A form UN4 would be used by the registered owner for example. Note - an equitable charges can be noted as such and as an Agreed Notice. If so then form CN1 and DS1 would be the forms to use The register will confirm how the charge/debt has been protected

Hi, the register states "UNILATERAL NOTICE in respect of an equitable charge created by an interim charging order of the CNBC dated X" "beneficiary: [firms name]" Where does it confirm how the charge has been protected? if it stated an agreed notice rather than unilateral would it then be a CN1 and DS1? Thank you very much.
