After a divorce I applied for house transfer from myself and ex wife to just me. The house transfer and my lump sum payment to my ex wife was defined and signed off by a judge in a consent order.
I have now recieved a letter from HMLR stating they cannot proceed with the transfer because I have 'neither a Land Transaction Return certificate  nor a submission Reciept' (electronic SDLT5)
They go on to state 'either lodge as required  a letter stating why such a certificate  is not required  and refer to the relevant  provsions of the Finance Act 2003 that spports your statement  or supply the relevant certificate or  or receiept.'

My understanding is that because the house transfer is due to divorce there is no need to lodge a return for or pay SDLT.

As such is the letter just confirming  for me to confirm the transfer is  due to divorce  and to send a copy of the consent order if so what section of the Finance Act 2003 do I refer to without paying over £1000 to a solicitor to find out ?

Colin - I would suggest you respond as per the request issued and confirm why the certificate is not required. You don't need to confirm what legislation applies but you can send a copy of the consent order if you wish to confirm why the transfer has taken place.

Ioan Vacaru -  The SDLT 5 certificate is issued by HM Revenue & Customs so you need to contact them about it - Stamp Duty Land Tax: general enquiries - GOV.UK
