There is a restriction on my husbands property that it can’t be sold without his brothers consent . 
This was put there purely as his mother wanted it, over the past 21 years his brother has no interest in the property . My husband has asked him to remove the restriction and my brother in law will fill out a form RX4 , is this the correct form to fill out ? Plus should my husband do a form RX3 at the same time or is form RX4 from his brother sufficient . 
Also we were looking at form RX4 and are a little confused with section 8 Where it says the application relates to - giving 3 options . We are not sure if it should be
“ the estate “ or 
“ the registered charge dated ( ) in favour of ( ) 

what do we select and if it is the latter is it my husbands name it is in favour of as he is the owner of the property .

Tehmina - form RX4 is the correct form for the restrictioner himself to withdraw his restriction
You do not need a form RX3 as well
Panel 8 should refer to the restriction details themselves so date and brother and the legal estate as it's not linked to a registered legal charge it seems
