Hi, My parents both passed away in the lat couple of years. They were tenants in common and had a Property Protection Trust in the Will, with me & my sister as trustees and beneficaries..Their house was left to myself and my sister, again as sole joint executors and beneficaries.I am buying out my sisters half of the house so I can live in it as my sole home/property.
We have a solicitor dealing with the transfer of equity however he has advised me yesterday that I need to get the Grant of Probate amended for my mum (the most recent to pass away) as my middle name and my sisters middle name are not included on the Grant of Probate (Mum's is) and the middle names are required to match the transfer deed . Note our middle names were not included in the will either.

Please can you advise if there is an alternative way that we can do this, rather than going through the stress and delays of getting the GOP amended please? Many thanks for your help.

Hi Debra - sorry to read of your losses.
It's really a Q only your conveyancer can answer as they will have their own set of requirements and it's rarely just what they think HMLR will require
From a purely registration perspective we will treats every application on merit and the fact that the conveyancer is lodging it and acting for you can often allow some leeway when it comes to name variations where you have a short and long version of names
In most cases we may accept a conveyancer's certificate/confirmation that the persons named in X are one and the same as those named in Y for example. We will then register the 'fullest' names
But as I said we won't make that decision until we see the actual application and all the supporting evidence - hence very much something to query with your conveyancer as it's not all about what we require in such cases
