Thank you. I am severing joint tenancy because I have received a cancer diagnosis whilst going through a divorce incase I should die, then my half of the house could pass to my sons instead of all of it going to my husband and new partner. If I am OK and live, can we transfer the title to my name only afterwards as we were planning to do as I was going to transfer our holiday home to him ? Do you see any pitfalls in this severence that perhaps I can't Thank you.

Lynn - so sorry to read of your health issues. Severance does not change or update the legal ownership. It simply restricts the surviving joint owner should the other owner die. A transfer of legal ownership can be done at any time and it's always as a whole (not a share). For example if the property was to be transferred from your joint names to just you or from joint names to your sons. I'd suggest seeking some legal advice around the specific circumstances and needs of everyone involved and how the legal ownership (that we register) and beneficial ones (that the severance relates to) work and how they impact depending on future scenarios

Essentially I am suggesting that what you are trying to perhaps do may not achieve what you think it does. And going forward understanding what options exist for you, your joint owner and sons both re the property and more will help in the long run as all understand options and what can happen next.

Thank you, I have made an appointment to discuss this with a solicitor who I shall be asking to write me a new will and do a Power of Attourney which may work out quite expensive ,so if I do the severence myself, it is my understanding that if my husband and I agree to this , we will create a notice of severence explaining our wishes and the percentage we will have which will be equal parts , then date and sign. The notice will have the address, title number, request for form A restriction and acknowledement of receipt by my husband, it will be handed to him. We send the notice and SEV form to land registry by tracked post and is that all. The notice of severence will be signed together and the original sent to you, but could we sign 2 more to each keep with our wills? Thank you

Lynn - very wise and all noted and appreciated re the severance also. All correct but it's the understanding of what's behind the severance and that detail is key to both you, your husband and sons understanding what it means as and when future events occur to impact on the legal and beneficial ownership of the property. Your wills/trust are key from a legal perspective and a shared understanding between you all. Applying for a form A restriction through severance is fine and merited but it's what's behind that which is key and we don;t record or register all the additional details re the wills/trust etc
