We are completing a Deed Of Variation for our house sale.  Property Management Company have signed the Deed of Variation. Please can you advise if ID2 form is required for the Management Company, if the company is not lodging the deed itself , but merely signing to give consent. <br> <br>

R Markova - Practice Guide 67 explains how and when ID1/ID2 forms are required re specific transactions - <a href="https://www.gov.uk/government/publications/evidence-of-identity-conveyancers">Evidence of identity (PG67) - GOV.UK</a> <br> See section 4 which lists those transactions that require identity verification. Much will depend on what your Deed of V is seeking to vary and whether that impacts as for example a new lease or not

Many thanks for responding.  The Deed of V is regarding the estate rentcharges. The property we are selling is Freehold, however subject to estate rentcharges.  <br> Can you advise, if ID2 form will be required for the Management Company<br> <br> Following new clause is added. <br> <br> Variations to the Transfer<br> 1. A new clause K (8) shall be added to the Transfer as follows:-<br> “In relation to the Nominal Rent Charge and the Variable Rent Charge, the person or<br> entity who has the benefit of them shall have all the powers and remedies conferred<br> by the Law of Property Act 1925 to enable it to recover and comply the payment of<br> the Nominal Rent Charge and/or the Variable Rent Charge save that s.121 (3) and<br> (4) of the Law of Property Act 1925 shall be excluded

R Markova - if it's a Deed of V re an already registered transfer then we won't generally require identity verification on submission of the application
