Hi, we are spouses who jointly own a house with large garden. We hope to sell the house with small garden and separate off the remaining garden for potential development in the future. We much prefer to have the title split before sale of the house and believe that land registry may be ok with this if we proceed by gifting the garden to one of us and completing the process of obtaining a separate title that way (as there will be no transfer of sale proceeds at that initial stage).
