Im in the process of purchasing a property from some builders that part exchanged with the previous owner. At present they are trying to register the property in their name but can't get hold of the executor to complete the ID1 form. This will have serious repercussions for the sake of the property. Does this mean the property is unsellable?

F W - whether it's unsellable as a result would be dependent on resolving the issue. I don't quite follow the part-exchange, previous owner and executor link however. If the exchange was with the previous owner then it's their identity that needs verifying or for the conveyancer to confirm 'satisfaction' re their legal representation for example I assume the previous owner has died at some crucial stage and as such the executor is now transferring ownership so they'd need to execute any transfer and have their identity verified

There was a lady and her husband that owned the property, the husband passed away and the lady decided to move to a retirement village (which was a new build). She part exchanged her property with the new home she wanted to move into so, basically sold it to the builders that owned the retirement village. The builders then re marketed the property and I accepted my offer. It came to my solicitors attention that the deeds were still in the name of the lady that originally owned the property as the builders solicitors did not transfer it to their names last year when they brought the property. After a lot of tooing and froing, the only thing left to do now is to get the executor of the husbands will to provide an ID1 document. However after a month of trying they can't get hold of him still. Unless this matter is resolved my whole chain will collapse.

F W - if they owned the property jointly then the sale/part exchange would be by her alone as the surviving joint owner. The husband's executor does not have to be a party to any sale/transfer

This is the confusion as the solicitors are saying this but land registry have said they need this. The property was jointly owned and this is clearly stated on the current land registry. She has provided all relevant details but land registry are asking for id1 form from an executor aswell, who they have not managed to contact. The title number of the property is SF423416. If you could please look into this matter.

F W - as the transfer has been completed by two individuals we need identity verification for both. The issue appears to be that the verification being relied upon is too 'old' hence the need to complete the verification again SF423416

The second party was appointed to act with the surviving registered owner to overreach the form A restriction on the register and allow the sale/transfer to take place. Whilst there was no need to use the deceased owner's executor we require a correct and up to date identity verification
