Hi,

I am purchasing a piece of garden land from a neighbour which is on its own title separate from her home. We have agreed the details and price etc, and I am now trying to ensure we each fill out all the necessary forms correctly, and have some questions regarding them which I am hoping you can help me with. Apologies in advance for the long post, I thought it would be better to collect all my questions into one post than ask them individually.

As I understand it, we will have to complete forms TP1 and AP1 and an ID1 form for each of us.

Question 1: The current title for the property still lists both her and her late husband as owners, although he died some time ago. Will she need to submit a form DJP to remove his name in order to complete the sale? Could this be submitted at the same time using the application priority list in panel 4 of form AP1 as I have seen in examples from HMLR, especially given that the removal of her husband's name would relate to the whole property, but the partial transfer would only relate to part of the property and so would require different answers to panel 3 of form AP1

Question 2: The current title is missing one of her middle names, will she have to apply for a change of name using the or will this be unnecessary? Again, could this be submitted on the same AP1 form as the partial transfer? If the name change and removal of deceased proprietor must be submitted separate to the TP1 form, can they be done on the same AP1 form?

Question 3: The land is described in the title as "Land behind..."  followed by the street address of the two properties that the land is behind, but does not include a post-code anywhere. Does this imply the post-code field in panel 1 of form AP1 should be left blank?

Question 4: I just want to check the wording I will use for the property description in panel 3 of the AP1 form: "Edged green and numbered 2 on the plan to the transfer dated [date on corresponding TP1 form]"

Question 5: I just want to check the correct wording and fee for the partial transfer in the application priority list in panel 4 of the AP1 form:
"Part transfer for monetary consideration". The price is going to be £15,000, making it a scale 1 fee, and as we are not using conveyancers we will be applying by post so the fee will be £45

Question 6: In panel 5 of form AP1, documents to be lodged, I will include an ID1 form for each of us and the TP1 form. Does the plan that will be attached to the TP1 form also need to be declared here?

Question 7: In panel 6 of form API, is the applicant the person buying the land to be transferred out of the existing title, or the existing owner?

Question 8: Panel 7 of form AP1. Should the sender generally be the seller, or the buyer, or is it not important who sends the application? Also, what is the reference field used for?

Question 9: In panel 9 of form AP1, "Address(es) for service for each proprietor of the registered estates to be entered in the register", I am guessing this is just my (the buyer's) details?

Tom - Q 1: No, you need a certified copy of his death certificate and you would simply list that as a document lodged on form AP1. 

Q 2: You would need to provide evidence to confirm the correct name (copy of passport name page/driving licence) and confirmation that they are one and the same person for example.

Q 3: land doesn't have a post code as no point of postal delivery. Leave it blank

Q 4: word it to match how you are showing the transferred extent on the plan

Q 5: Correct but simply state Transfer and then the actual amount paid

Q 6: No as it is part of the form TP1

Q 7: panel 6 is You

Q 8: panel 7 would be you as the buyer. You could insert a reference if you were submitting multiple applications and needed to reference each. 

Q 9: correct
