I am in the process of purchasing a plot of land. The whole land is accessed by a registered right of way which includes heirs and assigns, over a registered piece of land of a third party The vendor's solicitors are refusing to include a clause in the TP1 of my plot to record the existing registered right of way. The original document relating to the right of way will stay with the remainder of the land. Can a copy of the document making the right of way be registered at the Land Registry with my application for TP1. If so what is required please. Thank you

Jill - you need to rely on the conveyancers here. If there's an existing registered right of way on the seller's title it can be carried forward to the transferred part when registered. There's no need to repeat the right in the TP1 in such cases.
