Hi,<br> <br> How should section 10 of the TR1 form be filled out when you have a declaration of trust being drafted by a solicitor? I am unsure if the second or third tick box should be selected. Can you confirm?<br> <br> I am buying a property with my partner. The intention is for us to "hold the beneficial interest as tenants in common in equal shares" meaning the second tick box seems relevant. However, the declaration of trust will deal with unequal deposit monies being returned first before the equal shares of the property are then distributed upon sale. Therefore, perhaps tick box three is more relevant. If so, would we then need to reference the declaration of trust? If so what should this reference say?<br> <br> Also, can you confirm if the TR1 form needs to be signed by us the purchasers?<br> <br> Many Thanks,<br> <br> Victoria

Hi Victoria - we can't tell you how to complete panel 10 above and beyond the guidance provided online - <a href="https://www.gov.uk/government/publications/registered-titles-whole-transfer-tr1/guidance-completing-form-tr1-for-the-transfer-of-registered-property">Guidance: how to complete form TR1 - GOV.UK</a> <br> All I can add is that either option you refer to works and the ting to consider is whether you want to include reference to the Dec of T and submit a copy to be on record or not. <br> If you are completing panel 10 then yes the TR1 needs to be executed by you as purchasers
