I would be most grateful if someone could answer the following queries.

Form AS1 Panel 2.5
When there is a Grant of Probate with two named executors - is it necessary to put the names of both persons appointed by the Grant of Probate or can you just use one i.e. the one who is completing the forms and sending them off?

Form AP1 Panel 4:

If an inherited property is valued at 220K and I am buying my brother out at £110k. In panel 4 do I write ‘Transfer’ and put a value be £110K? I have looked at the guidance but remain unclear as to what scale I use and what fee I pay. Would the fee be based on the full value of the property or the half value that I am paying? Do I use scale 1 or 2?

Although there are two named executors on the Grant of Probate it is possible to use just one named executor as the transferor?

I am unclear as to how many ID forms are required. Re TR1 if I was the sole transferee and the sole applicant i.e. the one completing the form, I am assuming that only I would require an ID1 form. Is that correct?

Patrick - I'll do my best although your panel numberings don;t match the forms in every case?
Form AS1 Panel 2.5 - All personal representatives named in the grant must join in any disposition of the legal estate. But if you are buying the other beneficiary out then it's form TR1 you need and not form AS1

Form AP1 Panel 4: - if you are buying the other beneficiary out then the consideration is the amount being paid and that is the figure you should include in panel 4. The fee is payable under Scale on that figure

Panel 3.4 - both executors will be the transferors

Panel 3.8
Yes -  ‘consideration’ here would be £110K

Form ID1
You need to have both your identities verified

Re TR1 So when buying out it is scale 1 that is used and that would be £230?


AP1 - Panel 9
I've watched the video but still not really sure what to put here. Should the 4th box be crossed and both my address and that of my brother be written here?

Patrick - £230 is the correct fee
Panel 9 - if you and your brother are the Transferees, so the two new registered owners, then we need to know what contact address details you each want. So complete panel 9 to provide those details for each of you as appropriate
