Hello, I made a DOT with a partner and he invested a sum of £35k into my property, we have since married and now separated, we have reached an agreement and I am repaying a sum to him, however I'm not sure which form I need to complete to remove the restriction from the register. I have attached copies here, I currently have a mortgage and a second charge mortgage which will both remain in place, I simply need to remove my estranged husband (wth his consent). Thank you

Hi Adam Thank you for your help, am I correct in thinking I would complete the form RX4 and attach a statement of truth as evidence to support the application, also am I correct in my belief that there is no charge for this? Thanks again for your assistance. Mandy

Hi Adam Apologies, I think I may be mistaken and that the form I would complete is RX3 (I assume if my husband made the application, he would complete form RX4) Is that correct? So assuming I have this right, I would complete and RX3 and attach a statement of truth from him (or can I do that and supply evidence of funds being transferred to him?). Hi Mandy - section 6.2 and fourth bullet point applies. As you are applying using form RX3 it's your statement of truth
