My Mother passed away in 2020, however, my Father did not remove her from the deeds at the time and he passed away 2 weeks ago.

I notice from the form AP1 it needs to be completed by my father, however, I am beneficiary and Executor of the Will for both of their estates. I will be applying for Probate for my Father once we have the death certificate but just need my Mothers name removed.

I need clarification on how to get my Mother removed please.

Documents you need to send

To remove a deceased joint owner from the property record, please complete:

and send either:
  • certified copy of the death certificate
  • certified letter of administration or probate

Please do not send originals. All certified copy deeds and documents that are lodged with an application will be destroyed following our scanning process and no copy documentation will be returned on completion of the application.

Is there anyway I can get my Mother removed first or does this need to be done at the same time..?? I have her Death Certificate.

Belinda - the guidance is to explain how to apply to remove your Mother from the register first.
