Need help filling out AP1 and As1

The instructions for sending in the AS1 and AP1 forms say they should be sent with "an official copy of the probate". The grant of probate I need was issued in 1994 and I don't have an original. I applied for a copy from the probate office, which I now have, but does this count as an "official copy" for the purpose of registering the AS1 and AP1

Iain - yes if you applied for and obtained it from the probate office. They, like a lot of agencies, can issue official copies for this very purpose to enable people to keep the original safe and use the official copy for 'official' business.

Could you please help me with the registration fee for a property worth £275,000 on the open market. It is being inherited as part of an estate. I've approached 2 different solicitors and they have given me very different figures. In other words, what figure(s) should go in section 4 of the AP1 form. Many thanks

Iain - if you are applying to register an Assent then you should complete panel 4 of form AP1 to refer to Assent > £275,000 and pay the Scale 2 registration fee of £100 as you are applying by post<br> <a href="https://www.gov.uk/guidance/hm-land-registry-registration-services-fees#scale-2-fees">HM Land Registry: Registration Services fees - GOV.UK</a>

At the moment the property in question has no title number, so panel 1 on the AS1 form will be blank. Does this impact whether it would be scale 1 or scale 2?</p> <p></p>

Iain - if the property is unregistered then it will impact as the registration fee for a first registration is assessed under Scale 1 and not Scale 2

<p>Hi Adam. I would like more of your advice if possible. The house that me and my brother are trying to get into our names via the AS1 form was in my Dad's name (he died in 1994) and never got transferred to my Mum's name (who died earlier this year). My Dad's solicitors tell me that there is no title number and they have the deeds, so it sounds like it has never been registered with the land registry. The search for land and property information on gov.uk gives "no information held" and they lived in the same house for 60+ years, so it is possible that it was not registered. Does the death of my Mum (and the need to sell the house) create a "compulsory first registration" event therefore, so that as well as AS1 and AP1 we will also need to fill in the forms FR1 and DL. I appreciate that this forum is focused on filling out AS1 and AP1 forms, but I think you might be able to point us in the right direction</p>

Hi Iain - if it's unregistered then the Assent (form AS1) will trigger the need to register for the first time using forms FR1 and DL. Form AP1 is not required as that's only used where a property is already registered

Iain - you won't be needing all 3 forms if it's unregistered as it will be FR1 and DL for that type of application<br> Form AP1 is for registered land online<br> If you don't use a conveyancer/solicitor then you will need your identities verified using forms ID1/ID3 as appropriate - <a href="https://www.gov.uk/government/publications/evidence-of-identity-conveyancers/practice-guide-67-evidence-of-identity-conveyancers#confirmation-of-identity">Practice guide 67: evidence of identity - GOV.UK</a>
