My sibling and I are looking to sell/gift land within the family, my 50% share is being gifted and my sisters 50% share is being sold for 40k cash. How do i disclose this in section 4 of the AP1 form?

Would the following be correct?

4 Application, priority and fees
Applications in priority order Price paid/Value (£) Fees paid (£)
TRANSFER 50% BY WAY OF CASH £40,000 £45
TRANSFER 50% BY WAY OF GIFT £40,000 £45
Total fees (£) £90

J Wallis - No as it is one Transfer. The registration fee for a Transfer of shares for value is payable under Scale 1 on the value of the stated consideration

Land registration is complex, designed to protect legal and financial interests in property. There can be significant consequences for any error. Please consider seeking legal representation. Before making an application without legal representation, it is important to consider the benefits of using a conveyancer.

Thank you. Understand now that for land worth 80k, the total fee will be £45 but what would be acceptable for the wording in column 1? Would stating ‘Transfer’ be sufficient or does it need to be more detailed for example ‘Transfer by way of Cash and Gift’?

If there is only one Transfer and it states the consideration then panel 4 of form AP1 need only state Transfer
