Hello

i I have a couple of things I would just like to confirm please re the above 2 forms please. I have followed the guidance notes but would just like to confirm that I haven’t misunderstood in a couple of areas please. The background is that a sole executor is transferring the deceased’s property ( which they owned on their own) to one of the beneficiaries, who is buying the other beneficiaries out.

On form TR 1

Panel 8 - the amount here is the amount the transferee is paying to buy out the other beneficiaries not the full market value. Is that correct please?

Panel 12 - As it is a sole executor transferring to a single individual transferee (panel10 and 11 blank) then only the Transferor has to sign here (along with witness) not the transferee. Is that correct please?

Form AP1

Panel 4 The guidance notes and u tube video say you put how much is being paid for the property and if no money is changing hands put market value. So in this situation it seems we should put int the two thirds value that is being paid as the other third is inherited. Is that correct please or should it be the full market value? It actually makes no difference to the fee due as both values fall in the same range.

One final generic question. Does the executor when the put in details as transferor need to say Jo Bloggs as executor of Jean Bloggs. Or is the fact the attach certified Grant of Probate enough.

Many thanks

Angela - form TR1 - correct - Guidance: how to complete form TR1 - GOV.UK
Form AP1 - you put the amount being paid (the consideration)
Generic Q - Jo Bloggs as executor (or personal representative) of Jean Bloggs (deceased)

Land registration is complex, designed to protect legal and financial interests in property. There can be significant consequences for any error. Please consider seeking legal representation. Before making an application without legal representation, it is important to consider the benefits of using a conveyancer.
