I (LH) joint own a property with my ex-husband (EV). As part of the divorce, I (LH) am transferring my half of the property to him (EV) for an agreed sum of money, as per the Consent Order. Neither of us are represented by a conveyancer. I have a few queries about the forms we need to complete, as follows:<br> &#160; <ol> <li>Do we need to complete both forms AP1 and TR1 (whole title transfer as part of divorce)?</li> <li>As there is no conveyancer involved, a&#160;charterer accountant has agreed to verify our ID. I understand we will need to complete Form ID3. Do we also need to complete Section A, B1 and B3 of Form ID1?</li> <li>Is the following correct for forms AP1 and TR1? - LH is the transferor. EV is both the transferor and transferee. EV is also the Applicant.</li> <li>For the purposes of form AP1 panel 4, how is the price/value calculated - (a) the whole (100% of) property value, (b) the 50% being transferred, or (c) the sum of money being paid by the transferee (EV)?</li> <li>Can you confirm which LR Fee Scale we need to use,&#160;and how the amount/value is calculated (same as above question)?</li> </ol>

Hi L H - the key thing to understand is that the legal ownership (registered title) can only ever be transferred as a whole. You can't transfer a share even though it seems or feels like that's what you are doing.<br> 1) Yes as AP1 is the application form and TR1 is the legal deed (transfer) - the 2 of you are transferring the WHOLE to just EV<br> 2) If you are not using form ID1/conveyancer then ID3/others as listed can be used -&#160;<a href="https://www.gov.uk/government/publications/evidence-of-identity-conveyancers">Evidence of identity (PG67) - GOV.UK</a>&#160;. ID3 stands alone so form ID1 is not involved/completed&#160;<br> 3) LH and EV are the Transferors. Hello Adam, I have read the guidance but parts of it aren't entirely clear, so thank you for these clarifications and the quick response. Just to confirm I have understood correctly:<br> &#160; <ol> <li>I do not need ID1 form at all, just ID3 (one form for each of us)?</li> <li>If we are <strong>not </strong>submitting ID1, does this mean we <strong>do not need </strong>to attach a passport photograph (only a photocopy of our passport details page for ID3)?</li> <li>On form AP1 panel 4, do you mean that we should write &quot;Transfer 2 to 1&quot; under 'Applications in priority order' column?</li> </ol>

<p>To add further context, there is no outstanding mortgage on the property. But EV will be taking out a new mortgage (sole) in order to pay me (LH) the agreed sum of money. Does this change anything with respect to forms AP1 and TR1?</p>

Laura H - yes to 1, 2 and 3<br> Re the 'new' mortgage IF that's being applied for at same time then it will impact and you will probably find the lender insists that you use a conveyancer

<p>Hello Adam, thank you for your reply and helpful information. I should clarify that a conveyancer is dealing with the mortgage but we are filing Land Registry (for deed transfer, as above) to save on costs. The conveyancer is aware of this.</p> <p>Does that change anything in regards to how we fill in forms AP1, TR1 and ID3?</p>

Hello Laura - no, just change anything but I was concerned that you might be doing this all yourself only to find the lender said No, you can't do it yourself. I assume there will be two separate applications as in one to transfer as submitted by you and one to mortgage as submitted by the conveyancer.&#160;<br> But not an issue for us either way - simply me flagging a possible issue
