I am writing on behalf of an elderly friend who is sorting out his affairs. He asked me to try and understand how to get the following removed from his property title: Title Number CB346459
"General Equitable Charge created by a deed dated 11th July 2006 made between (1) My friend's Sister in Law and (2) My Friend  but neither the original Deed nor a certified copy or examined abstract of it was produced on first registration.
Note: This information was taken from a Land Charge Class C (III) Dated 25th July 2006 reference number 120810.

My elderly friend has no understanding of why this charge was registered and equally no understanding of how to get it removed...  Is it the case that anyone can register a charge on a property without supporting documentation ?

Andrew - the entry was added as a result of the Land Charges search result that accompanied the application to register the property for the first time in 2009
Land Charges are a means of registering such an interest with regards unregistered land/property It is not the case that someone can register such a charge without supporting documentation
To cancel the entry please lodge an application in form CN1 which must be accompanied by a cancellation certificate as issued by Land Charges with regards the land charge itself - see section 5 of Practice guide 63: the land charges registers and agricultural credits register: registration, official search, office copy and cancellation - GOV.UK
I note that the issue re the land charge was raised with the solicitor who acted for the owner in 2009 and correspondence was issued to him by post at the time
